These Terms of Service ("Terms") govern your use of smartersbeyond.com and any services or digital products ("Services") offered by Smarters Beyond, located at Ul. Ludwika Idzikowskiego, 00-710 Warszawa, Poland ("we", "us"). By using our website or purchasing our Services, you agree to these Terms.

1. Our services

We provide website and mobile app development, digital marketing (SEO, social media management, advertising), brand design, business growth consulting, and downloadable digital products. The scope, deliverables, and timeline of custom projects are agreed in writing before work starts.

2. Orders and payment

Every price shown on our website is a one-time payment. We do not sell subscriptions, and no purchase renews automatically or charges you again.

• Prices are shown on our website or in a written quote and are charged in the currency displayed at checkout.
• Payments are processed securely by our third-party payment provider. We do not store your full card details.
• Applicable taxes may be added at checkout.

3. One-time payments

Each purchase is billed once, in full, at checkout. Follow-up or additional work is quoted separately and only starts after you approve the quote and pay for it. Nothing on this site repeats without a new payment from you.

4. Digital products

Digital products are licensed to you for your own business use. You may not resell, redistribute, or share them unless the product description explicitly allows it.

5. Client responsibilities

You agree to provide accurate information, timely feedback, and any content needed for your project, and confirm you have the rights to any materials you supply to us.

6. Intellectual property

Once a project is paid in full, final deliverables created specifically for you are transferred to you, except for third-party assets, open-source components, and our pre-existing tools, which are licensed for use within the deliverable. We may show completed work in our portfolio unless you ask us not to.

7. Refunds

Refunds are handled according to our Refund Policy.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim relating to the Services is limited to the amount you paid us for those Services in the 12 months before the claim. We are not liable for indirect or consequential losses, including lost profits. Results of marketing services (such as rankings or sales) are not guaranteed.

9. Termination

Either party may end an ongoing engagement with written notice. You remain responsible for work completed up to the termination date.

10. Governing law

These Terms are governed by the laws of Poland and applicable European Union law. Consumers keep any mandatory rights granted by the law of their country of residence.
